Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AnswerCatch website and the AI receptionist and missed-call recovery services (the "Services") provided by AnswerCatch ("AnswerCatch", "we", "us", or "our"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the Services, and you must use them for business purposes. You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.

2. The Services

AnswerCatch provides an AI-powered voice agent that answers calls on your behalf, qualifies callers, captures details, books appointments to a connected calendar, and sends you lead notifications. Features vary by plan. We may add, modify, or discontinue features over time. Setup timelines (typically 24–48 hours) are estimates, not guarantees.

3. Free trial

We may offer a 14-day free trial. Unless you cancel before the trial ends, your subscription will begin and the applicable fees will become payable. We reserve the right to determine trial eligibility and to modify or withdraw a trial at any time.

4. Fees, billing & taxes

• Subscription fees are billed in advance on a recurring monthly basis at the plan price you selected (Starter, Pro, or Premium).
• One-time setup fees apply per plan and are billed once at onboarding, unless waived under a promotion.
• Fees are stated in U.S. dollars and are exclusive of taxes, which you are responsible for where applicable.
• By providing a payment method, you authorize us (and our payment processor) to charge the recurring and one-time fees due.
• We may change our fees on a prospective basis with reasonable notice; changes will not affect the current paid term.

5. Cancellation & refunds

The Services are month-to-month with no long-term contract. You may cancel at any time; cancellation takes effect at the end of your current billing period. Please review our Refund & Cancellation Policy for details on refunds and setup fees.

6. Your responsibilities

• Provide accurate onboarding information and keep it up to date;
• Ensure you have the rights and consents needed to forward your calls to us and to have callers' information processed;
• Comply with all laws applicable to your business and your customers;
• Promptly review booked jobs and lead alerts — you remain responsible for serving your customers.

7. Acceptable use

You agree not to use the Services to: violate any law; harass, defraud, or harm others; transmit unlawful, misleading, or infringing content; interfere with or disrupt the Services; attempt to gain unauthorized access; resell or provide the Services to third parties without our permission; or use the Services for emergency (911-type) call handling or as a substitute for emergency services.

8. Telephone & consent compliance

You are solely responsible for compliance with laws governing calls, recordings, transcriptions, and messaging in your jurisdiction, including obtaining any required caller notice or consent (for example, call-recording and one- or two-party consent laws, and the TCPA where applicable). You will not use the Services to place unlawful or unsolicited calls or texts.

9. Intellectual property

The Services, including all software, content, and trademarks, are owned by AnswerCatch or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription. You retain ownership of the data you and your callers provide; you grant us the rights needed to operate the Services for you.

10. Third-party services

The Services may integrate with third-party tools (such as calendars, telephony providers, and payment processors). Your use of those tools is subject to their own terms, and we are not responsible for third-party services.

11. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that the AI will correctly handle every call. You are responsible for reviewing outcomes.

12. Limitation of liability

To the maximum extent permitted by law, AnswerCatch and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any lost profits, revenues, business, or data, arising from or related to the Services. Our total liability for any claim will not exceed the amount you paid us for the Services in the three (3) months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless AnswerCatch from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your content or your callers' data, or your violation of these Terms or applicable law.

14. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or if we discontinue the Services. Upon termination, your right to use the Services ends; provisions that by their nature should survive will survive.

15. Governing law & disputes

These Terms are governed by the laws of the United States and the state in which AnswerCatch is established, without regard to conflict-of-laws rules. You agree to resolve disputes in the courts located there, unless applicable law requires otherwise. If any provision is found unenforceable, the remaining provisions will remain in effect.

16. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date and, where appropriate, notify you. Your continued use of the Services after changes take effect constitutes acceptance.
